the republican house majority leader may have known about former cia director david petraeus' extramarital affair before the president did. that's according to aides to congressman eric cantor who tell us he found out from an fbi employee concerned that national security might have been breached as a result of the affair. cantor was told on october 27th. president obama didn't find out about the affair until after election day. congressional leaders from both parties are upset that neither they nor the president were informed until late last week. >> obviously this was a matter involving a potential compromise of security. and the president should have been told about it at the earliest date. >> reporter: a u.s. official said there was no breach of security as a result of the affair. a cantor aide says the congressman called the fbi's leadership to report the information he got on october 31st. but according to "the wall street journal," the fbi's probe had already been under way for months. on the investigation of general david petraeus. he resigned last week as head of the cia after admitting to an extra marital affair. tara merger joins us from washington. >> reporter: good morning. that's right. jill kelly a long time friend of the petraeus family apparently went to the fbi several months ago with her concerns and that led o to a revelation about the affair. and now congressments more information about the fbi's investigate. >> reporter: cbs has learned this girl, jill kelly triggered an investigation leading to the resignation of david petraeus. petraeus resigned friday after word got out he was having an affair with his biographer paula broadwell. his resignation caught many off guard. kelly went to the fbi after allegedly receiving e-mails from broadwell warning her to back off and stay away from my guy. officials say broadwell believed kelly was a romantic rival. broadwell made this comment about petraeus during a publicity tour. >> i think he has been a terrific role model for young people. >> reporter: congressional leaders say they are going to start an inquiry of their own.
about her personal access to david petraeus and that she, indeed, had unprecedented access to him. no other writer, no other reporter has had. so this just adds to the mystery. what really went on here? what did she know? what did she think she knew and why she was out there saying these things. >> and quickly, i want to talk about this benghazi issue as well. clearly these questions are not going to go away. this thursday it's time for him to testify about this. we all know that congress has subpoena power. so stepping down on friday, many have said this was an effort to try to sweep it under the rug and not testify. that's just not the case. if they want him, they got him. >> absolutely. congress has complete authority to subpoena him to compel him to appear. but for congress to subpoena someone, that becomes somewhat of a political decision. the intelligence committee run by the democrats, would they go ahead and take that step? who knows. the house intelligence committee, the house controlled by the republicans, they may well. at this point, it's very unclear. but it does seem
